1. Introduction

Welcome to Reflected Media! These Terms of Service ("Terms") apply to all photography and videography services provided by Reflected Media ("we", "us", "our"), a sole proprietorship operating in Phoenix, Arizona. By booking our services, you ("Client", "you") agree to be bound by these Terms.

2. Services

We offer specialized services in portraiture, commercial photography, and action sports/sports videography. Detailed descriptions of our service packages, along with pricing and availability, are available on our website http://reflected.media.

3. Copyright and Usage Rights

All photographs, videos, and media content created by us are exclusively owned by Reflected Media. Clients are granted a non-exclusive, non-transferable license to use the content for personal, non-commercial purposes, provided Reflected Media is credited as the source.
For commercial use, including advertising, clients must enter into a separate licensing agreement with us.

4. Pricing and Payment

Our pricing structure is detailed on our website. A non-refundable deposit of 20% is required to secure a booking.
Accepted payment methods are cash, card (processed via our website), or invoice. Full payment is due prior to the delivery of final images.
Late payments are subject to a 10% penalty of the total invoice amount for every 30 days past due.

5. Cancellation and Rescheduling

Cancellations or rescheduling requests must be made at least 48 hours before the scheduled session. Cancellations made with less notice will forfeit the deposit.
Rescheduling is subject to availability and may incur additional charges if it requires significant changes to the planned resources or schedule.

6. Delivery of Images

Final images are delivered within 7-10 business days following the shoot. Expedited delivery is available for an additional fee.
We primarily deliver images in digital format. Print and other media formats can be arranged upon request, subject to additional charges.

7. Limitation of Liability

We are not liable for any indirect, incidental, or consequential damages arising from the failure to perform any aspect of the project due to accidents, acts of God, hardware failure, or any other cause beyond our reasonable control.

8. Model Release

The Talent Release Form, available on our website, must be signed by all subjects of the photographs/videos. This release grants us the right to use the images for promotional, advertising, and other business purposes.

9. Client’s Use and Reproduction

Clients may not alter, sell, or distribute the images without prior written consent from Reflected Media. The use of images for harmful, illegal, or offensive purposes is strictly prohibited.

10. Privacy Policy

We are committed to protecting your privacy. Personal information collected during our business interactions will be used solely for the purpose of delivering our services and will not be shared with third parties without your consent.

11. Force Majeure

We shall not be liable for any failure to perform due to unforeseen circumstances or causes beyond our reasonable control, including but not limited to natural disasters, war, government regulations, disaster, strikes, civil disorder, or curtailment of transportation facilities.

12. Governing Law

These Terms are governed by the laws of Maricopa County, Arizona. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Maricopa County.

13. Special Clauses

Specific timing or release of images, such as posting on certain dates or times, requires a separate agreement and may be subject to additional fees.
